Rhino Play (SW) Ltd – General Conditions of Tender (2024)
Variations of Price; Website prices exclude shipping, installation and VAT. Comprehensive estimations supplied by Rhino Play (SW) Ltd are based on the cost of labour, fuel, transport & materials ruling as at the date of tender. We reserve the right to pass on to you any subsequent increase in cost, which may occur up to the date of commencement and or during the progress of the work. Prices assume good vehicular access and free working space within a 20m distance from the installation area. All prices are estimated until a Rhino Play (SW) Ltd survey has been completed.
Cancelled Orders:
There shall be a 25% administration charge for orders or part orders cancelled. All charges, including delivery, incurred in returning goods have to be met by the Customer (unless such cancellation is because of the Company’s failure to perform its obligations).
General;
Rhino Play (SW) Ltd. requires 72 hours’ notice in the event of a change in scheduling for our works and reserve the right to charge an aborted site visit charge of £675 should this change in scheduling occur within the 72 hours prior to our commencement on site. If installations are aborted on the scheduled day of installation the customer will be charged at a rate of £850 per day. Force Majeure, forecasts as to the dispatch of goods, installation of materials and completion dates of installations are given in good faith. We accept no liability whatsoever where non-delivery or delay in installation completion is due to events beyond the Company’s control. Rhino Play (SW) Ltd will not in any way be held responsible for any infringement or alleged infringement upon patents, registered design rights or copyrights by any designs provided by the Customer. The Customer will indemnify us against all damages and costs
incurred by us as a result of the infringement or alleged infringement. Rhino Play (SW) Ltd cannot be held responsible for any changes to design and as such any additional labour or materials, which may arise from this, will be charged for accordingly. It is the responsibility of the Customer to obtain any local authority planning permissions or relaxation of building regulations. Whilst the up most care will be taken during the installation process, we cannot be held responsible for any damage which may occur to the access route and as such have not included any cost of reinstatement or adjustment to make good any adjoining surface, soiling, seeding or landscaping.
During the installation period Rhino Play (SW) Ltd is not responsible for any damage that may occur to the products or surfacing as a result of vandalism or unauthorised access to the installation area. Rhino Play (SW) Ltd will take suitable precautions to secure installation areas during the scheduled works. Supply only items are goods are signed for. Rhino Play (SW) Ltd accept no liability for any damage after signing. after delivery to site by third parties or non-rhino play staff. Rhino Play Ltd will not accept liquidated damages by a main contractor under any circumstances. Rhino Pour (Wet Pour Safety Surfacing and bonded rubber mulch) surfaces are covered by our 5 year guarantee, Rhino Play equipment are covered by our general 10-20 year guarantee and as such we do not allow any retentions to be held. Existing equipment relocations are not covered by any onward guarantees.
Playground signs and notices:
It is the client’s responsibility to install safety signage and notices that clearly identify emergency contact details, safety information, usage requirements, any restrictions and specific equipment age ranges prior to the opening of a play area following any
remedial work or new installations.
Play Equipment, Sub-bases and Edge detail;
When provided a solely surfacing contract, all equipment, structures and sub-bases are to be installed by others prior to Rhino Play (SW) Ltd commencement on site unless otherwise agreed. All sub-bases must fall within the parameters specified in our technical data sheet. Any additional costs such as waiting time, additional labour and materials shall be charged for accordingly. It is the main contractor’s responsibility to ensure good drainage to any site. We cannot be held responsible for any loss or damage caused by any drainage issues, furthermore any additional labour, materials or waiting time costs incurred by Rhino Play (SW) Ltd will be charged to the customer accordingly. All edgings previously installed by others must meet Rhino Play (SW) Ltd specification.
Safety Surfacing: Wet pour rubber;
Every existing surface or sub-base has variable factors that can affect critical fall heights, wet pour is tested under laboratory conditions and surfaces are installed based on these results. Rhino Play (SW) Ltd cannot guarantee site specific compliances, on site HIC testing can be carried but will be chargeable. Fall height compliance on skim overs of existing surfaces cannot be guaranteed due to unknown specifications of existing surface. Every existing surface or sub-base has variable factors that can affect critical fall heights. Our ‘Rhino Pour’ product has been tested under laboratory conditions and is installed based on these results ONLY.
Rhino Play (SW) Ltd cannot guarantee individual site-specific compliances to BSEN1177 due to the variable factors. Wet pour rubber will be supplied in black as standard unless otherwise stated or specified, bonded rubber mulch will be supplied in brown/green mix as standard. For colour variations, please specify in writing at time of order. Flecked surfaces are based on a 10% colour and 90% black ratio. All rubber crumb and shred are susceptible to batch colour variations and therefor exact colours cannot be guaranteed. Rubber surfaces are not totally UV stable and are usually protected by free ranging stabilisers which travel out to the surface of the rubber to shield against UV degradation. This, combined with high levels of carbon black in the rubber compounds, can cause staining of any items that come into contact with an SBR or recycled EPDM surface. Whilst the colour coating does provide some protection against staining, once the surface is worn staining can occur. It is strongly recommended that any product containing SBR or black recycled EPDM granules or shred is not used in areas where crawling or regular bodily contact with the surface is likely. Rhino Play reserves the right to re-measure the site and amend the original quotation accordingly. Increase in area will be charged pro rata. Cost of material returns will also be chargeable. Curing times are dependent on weather conditions (i.e. temperature, rainfall, humidity) and may extend past the working day. Rhino Play cannot be held responsible for animal prints (i.e. fox, birds) or any vandalism/erroneous encroachment onto the area. Any remedial works in these instances will incur additional charges. During installation every effort will be made to create a seamless finish. However, this is not guaranteed where installs are greater than 80m2 and take place over multiple days and/or if installations are broken due to adverse weather conditions or other unforeseen circumstance i.e. time restrictions on site.
Loose Fill Surfacing Products (unbonded):
It is the purchaser’s responsibility to ensure the correct levels / depths of loose fill surfaces are maintained in accordance to current industry standards. Due to surface displacement loose fill surfaces require routine and ongoing maintenance and topping up to ensure compliance to current standards. It is down to the purchaser to order, install and maintain the correct levels.
Shelters:
Our timber shelters are intended to survive moderate wind and weather conditions in the UK, they do not come with structural calculations. Due to varying weather conditions around the UK it is the responsibility of the customer to highlight before quotation stage, the possible exposure to high winds and heavy snow conditions relating to their specific geographical location. It is also the responsibility of the customer to highlight any relevant topography that may affect shelter design, proximity to the coast, altitude of the installation and wind direction information. Some parts of the country tend to experience higher wind speeds and more extreme weather than others and we recommend the customer obtains structural calculations for any shelter ordered. Rhino Play can organise our shelters to undergo structural calculations for an additional fee based on the most relevant weather data for a specific area. Please note that it is the responsibility of the customer to take down and store shade sails prior to any adverse weather/if adverse weather is forecast. Removing the sail is to prevent damage to the shelter, the sail or surrounding property.
Structural Loading, Weight Compliance, Fixing Methods and Testing:
The Customer shall be solely responsible for ensuring that any roof structure, raised floor system, mezzanine, platform, supporting structure, or building element onto which equipment, materials, play equipment, or installations are placed is capable of safely supporting the imposed loads. Prior to commencement of the Works, the Customer shall obtain, at its own cost, all necessary structural assessments, calculations, certifications, and approvals from a suitably qualified structural engineer or other competent professional to verify that the structure complies with all applicable statutory requirements, building regulations, design standards, and load-bearing criteria.’
The Customer warrants that the roof, raised floor, and any supporting structures are suitable for the intended installation and use, including all static, dynamic, impact, operational, maintenance, environmental, and occupancy loading conditions associated with the play equipment.
Where the installation requires the use of bespoke, non-standard, project-specific, modified, or otherwise untested fixing methods, anchoring systems, support arrangements, or interfaces with the roof structure or raised floor system, the Customer shall be responsible for procuring and providing all necessary structural calculations, engineering assessments, testing data, certifications, and approvals demonstrating the suitability and adequacy of such fixing methods for the intended application. The Contractor does not warrant the performance, suitability, structural adequacy, or long-term durability of any fixing method that falls outside the manufacturer’s published installation guidance, recognised industry standards, or previously tested and validated installation methods. Any non-standard or untested fixing arrangement shall be deemed accepted by the Customer at the Customer’s sole risk unless expressly designed, specified, and certified by a suitably qualified engineer engaged by the Customer. Where required by the Contractor, the Customer shall provide written evidence of structural calculations, load assessments, pull-out testing, proof load testing, fixity testing, material compatibility assessments, and any other testing deemed necessary by the Contractor or the Customer’s engineer to demonstrate compliance with applicable standards and safe working load requirements. The Contractor reserves the right to suspend, modify, or refuse installation where sufficient evidence of structural adequacy, fixing performance, or engineering approval has not been provided, or where site conditions differ from those assumed within the supporting calculations or test data. The Contractor shall have no liability for any loss, damage, injury, defect, structural failure, movement, settlement, water ingress, delay, cost, or expense arising from:
(a) inadequate structural capacity of the roof, raised floor, or supporting structure;
(b) inaccurate or incomplete information provided by the Customer;
(c) the use of bespoke, non-standard, modified, or untested fixing methods;
(d) failure of fixings, anchors, supports, interfaces, or substrate materials;
(e) the failure of the Customer to obtain appropriate engineering design, calculations, approvals, certifications, or testing. Any additional costs incurred as a result of inadequate structural capacity, failed testing, redesign, strengthening works, remedial works, replacement fixings, delays, aborted visits, or additional engineering requirements shall be borne solely by the Customer. Nothing in these Terms shall be construed as imposing upon the Contractor any responsibility to verify the structural integrity, load-bearing capacity, engineering design, fixing performance, or compliance of the Customer’s building, roof, raised floor, supporting structures, or fixing arrangements unless expressly agreed in writing.
Security;
Site works will be protected by plastic barrier fencing throughout the installation period. Rhino Play (SW) Ltd have not included for the provision of Heras type fencing (unless stated), or any other additional security, which, if necessary, shall be provided by the customer.
Variations of Work;
Any adjustments of contract price necessitated by any variation of works shall be agreed at the time such variation is ordered & shall be changed on a time & material basis. When surfacing, all areas are subject to a re-measure upon completion. Rhino Play (SW)
Ltd reserve the right to increase the unit rates per metre should the area decrease in size or should any additional area increase the total number of days spent on site.
Facilities;
Unless otherwise stated, our quote is based upon direct & safe vehicular access for deliveries of our goods, plant & materials to the site of work & in the event of such access not being available at the time, any extra cost occurred by us shall be paid for by the customer / ordering party.
Site Preparation;
We require being able to dispose of excavated soil / spoil on the site that the works is taking place on. This can be tipped either in one pile or spread loosely in an agreed location within 20m of the equipment installation area. We do not allow any further preparation of the soil / spoil. If you require us to remove the soil / spoil from the site then the appropriate charges for this will be paid by the customer or ordering party. This does not apply if the quotation already clearly states that the soil has been priced to be removed from site. This policy is in line with our environmental policy of reducing emissions & soil contamination. Rubber mulch ground preparation includes for dug in edges and a geotex membrane only, all additional base preparations to this will be charged for.
Site Anomalies;
If we arrive on site & find that the information regarding the site layout, surface, access or preparation that we received from the customer over the phone/fax/post or e-mail is different, or has factors that affect our working timescale, cost & ability, then we reserve the right to pass this costing onto the customer / ordering party. Please advise of bad access at quotation stage. If asbestos is discovered on site all associated costs for removals and delays to an installation will be passed to the customer / ordering party.
Tree Preservation Orders and Statutory Consents: The Customer is solely responsible for determining whether any trees located within or adjacent to the work area are protected by a Tree Preservation Order (TPO), Conservation Area designation, or any other statutory protection or restriction. Prior to the commencement of any works, the Customer shall obtain and verify all necessary permissions, consents, licences, approvals, and authorisations required from the relevant local authority or other competent body. The Customer warrants that all required permissions have been obtained and remain valid for the duration of the works. The Contractor shall be entitled to rely on the Customer’s confirmation that all necessary permissions have been secured and shall have no obligation to investigate, verify, or confirm the existence or absence of any TPO, Conservation Area restrictions, or other statutory protections. The Customer agrees to indemnify and hold harmless the Contractor against any losses, costs, fines, penalties, enforcement actions, claims, damages, or expenses arising from the Customer’s failure to identify, disclose, or obtain the required permissions relating to protected trees or vegetation. Where the Contractor becomes aware of a potential TPO or statutory restriction, the Contractor reserves the right to suspend or postpone works until satisfactory evidence of the required permissions is provided by the Customer. Any resulting delays, additional costs, or rescheduling charges shall be the responsibility of the Customer.

*Laminated Timber and Platforms
Play-grade timbers, produced from high strength sawn, planed and treated Scandinavian Redwood. Laminated timbers reduce separation and splitting. Laminated timber sections are produced according to EN386:2001. Extremely smooth, high quality machined finish in 95mm
and 120mm sections. The glued joints are stronger than the timber itself. Edges are machine finished giving smooth and splinter free surface in accordance with BSEN 1176. All timbers are tanalith-E double vacuum pressure treated in accordance with BSEN 351-1. Timbers are covered by a 20 year guarantee against structural failure due to rot or infestation when a full Rhino Play Ltd yearly maintenance package is taken out, Timber equipment is guaranteed from the last date of installation (completion of works). This is made up of 1 year for parts & labour & 19 years for parts only. Standard guarantees against structural failure due to rot or infestation is 10 years. *Steel Ground Fixings
Manufactured from steel sections and plate produced to the relevant European standards. Hot dip galvanised in accordance with ISO 1461. Covered by a 20 year guarantee against structural failure. This is made up of 1 year for parts & labour & 19 years for parts only.
*Stainless Steel
All structural stainless steel frames constructed from pipe and box section with 3mm wall thickness, 304 grade stainless steel. Covered by 20 year guarantee against failure. This is made up of 1 year for parts & labour & 19 years for parts only.
*Galvanised Steel
Steel frames are from strong corrosion resistant galvanised steel for floors and brackets. Covered by 15 year guarantee against structural failure. This is made up of 1 year for parts & labour & 14 years for parts only.
*HDPE Coloured Panels & Play Panels
Coloured Panels are produced from 12mm HDPE. This material is extremely tough, wear resistant, chemical resistant, UV protected, fire resistant and will not rust. Covered by a 5 year guarantee. This is made up of 1 year for parts & labour & 4 years for parts only.
*Stainless Steel Slides & Tunnels
Constructed from 2mm stainless steel sheet on standard chute slides and 1.5mm on Tube Slides & Tunnels. Continuous welds on all seams. All slides fully comply with EN 1176-3. Covered by a 10 year guarantee. This is made up of 1 year for parts & labour & 9 years for parts only.
*Plastic Slides & Tunnels
Constructed from Polyethylene moulded sections with bolted joints. Covered by a 5 year guarantee. This is made up of 1 year for parts & labour & 4 years for parts only.
*Rope Nets, Rope Ladders, Suspension Bridges and Pull-up Ropes
Manufactured from vandal resistant steel core rope. End terminals are hydraulically pressed steel or aluminium ferrules with stainless steel bolts. Net joints and rope ladder rungs are from heavy duty custom moulded coloured plastic components. Hydraulically pressed aluminium net joints are used in high strength applications. Covered by a 2 year guarantee. This is made up of 1 year for parts & labour & 1 years for parts only.
*Chains
High grade stainless steel chain manufactured in accordance with ISO 1834. The chain is calibrated to give an internal width of less than 8.6mm to comply with the requirements of EN 1176. Covered by a 3 year guarantee. This is made up of 1 year for parts & labour & 2 years for parts only.
*Swing and Button Seats
Flat and Cradle seats moulded from high quality rubber encasing inner aluminium / steel frames. All seats are impact tested in full compliance with EN 1176-2. Covered by a 5 year guarantee. This is made up of 1 year for parts & labour & 4 years for parts only.
*Bearings
Standard Junior and Cradle swings consist of high wearing, anti-wrap swing bearings. Other bearings are high quality sealed bearings. Covered by a 1 year parts only guarantee.
*Bolts
Bolts are from high corrosion resistant treated, high tensile steel or grade 304 stainless steel. On stainless steel products all bolts are from grade 304 stainless steel. Heavy duty security coach screws are from stainless steel. All nuts are ny-lock nuts of grade 304 stainless steel. All structural bolts are covered by a 10 year guarantee against structural failure. This is made up

*Plastic Caps
Custom made, durable plastic caps cover all standard nuts and bolts throughout the range to give a smooth and tamper resistant fixing point. Made from tough, UV stabilised plastics designed to prevent vandals but allow future maintenance of the equipment.
Covered by a 5 year guarantee. This is made up of 1 year for parts & labour & 4 years for parts only.
*Security Fixings
Made from stainless steel (grade A2) for strength and corrosion resistance. Covered by a 10 year guarantee against structural failure. This is made up of 1 year for parts & labour & 9 years for parts only.
*Plastic Small Components
Plastic components are from UV stabilised Nylon, High Density Polyethylene or PVC. Covered by 5 year guarantee. This is made up of 1 year for parts & labour & 4 years for parts only.
*Springs
Manufactured from 18mm or 19mm diameter high quality spring steel. After coiling, the spring is phosphorised and then coated with a tough, durable polyester paint. Covered by 5 year guarantee. This is made up of 1 year for parts & labour & 4 years for parts only.
*Recycled Plastic lumbers*
Due to its nature, recycled plastic materials may show variations in colour, dimensions, surface finish, inclusions & cavities, these do not form any part of the guarantees. Recycled plastics will expand, warp or bend, again this is not a defect & does not form any part of the guarantee. UV discoloration does not form any part of this guarantee. Recycled plastics are covered by a 30 year guarantee against structural failure due to rot or infestation when a full Rhino Play Ltd yearly maintenance package is taken out, recycled plastic equipment is guaranteed from the last date of installation (completion of works). This is made up of 1 year for parts & labour & 29 years for parts only.
*Guarantees
All guarantees cover failure arising from material or manufacturing defects. General wear and tear through use, damage caused by vandalism or defects resulting from work carried out by a third party are not covered by our guarantees. Guarantees cover the full cost of the faulty parts. Additional fitting and associated surfacing cost are excluded. In accordance with our policy of continuous product development we reserve the right to make modification in design and specification. Where the Supplier is not the manufacturer of the Products, the Supplier shall endeavour to transfer to the Customer the benefit of any warranty or guarantee given to the Supplier. The Supplier warrants that (subject to the other provisions contained in these conditions) on delivery the Products shall be of satisfactory quality. The Customer is required to carry out all reasonable inspections to Products on the date of delivery for the purpose of identifying defects and/or damage and advise the Supplier of any missing or faulty goods within 7 days of delivery. Rhino Play (SW) Ltd accept no liability for lost or damaged deliveries.
Rhino Pour (Wet Pour Safety Surfacing) surfaces are covered by our 5 year guarantee and as such we do not allow any retentions to be held. The 5 years is made up of 1 year for materials & labour & 4 years for materials only. We do not guarantee the performance of our surfacing when laid onto existing safety surfacing, slabs, flags, soil, grass or other hard or soft areas not approved by us. Sub base inspections are based on integrity of surface at time of installation. When our rubber mulch product is supplied, light shedding of dislodged rubber shreds is expected. Mechanical, vandalism or deliberate damage is not covered. There shall be no problems caused by organic growth through the mulch surface. Surface growth is not covered. There are no formal maintenance requirements or routine procedures needed to maintain the integrity of the rubber mulch surfaces or for the warranty to remain valid. Any cleaning of the
surface or removal of growth etc. is purely at the discretion of the user for aesthetic reasons only, and only a light brush and water should be used. In the unlikely event that repairs are needed to a rubber mulch surface; Rhino Play (SW) Ltd’s liability is limited to re-establishing the integrity of the surface as fit for purpose only, we cannot accept complaints based purely on
aesthetics nor can we consider claims for consequential loss. No warranty will be offered with regards to any issues arising from sub-base movement caused by any means. Specified & recommended thicknesses of Rubber Mulch surfaces cannot be guaranteed as consistent when installing onto uneven & soft sub-bases. All colours are subject to ultra-violet light degradation and ultra-violet light discolouration and as such total colour stability cannot be guaranteed. All guarantees are only valid once full payment is complete and made within the pre-defined time frame.
Repairs to Existing Wet Pour Safety Surfacing; Rhino Play (SW) Ltd does not guarantee skims or overlays.
We do not warranty the bond between the old and new surface and any movements which may occur in the existing wet pour surface. Rhino Play (SW) Ltd cannot guarantee the bond between old and new wet pour safety surfacing. This is due to the differing rates at which the wet pour expands and contracts. This includes (but is not limited to) Edging Band Repairs and Patch Repair.
*Artificial Grass: Quality of Goods and Installation Creases. Due to the fact artificial grass is supplied on a roll and due to the molecular structure of the product it can crease. The product is not deemed to be faulty if a crease is visible and the product will de-crease on a daily basis. Creases will fall out within 3 months of the supply or installation. Seams. The supplier will endeavour to make all seams as invisible as possible. However, seams are occasionally visible due to the molecular structure of the product. This is unfortunately inevitable and can be influenced by a number of factors. Our Warranty does not cover seam visibility. Ripples. Under the influence of hot and cold weather changes, plastic will expand and contract. Whilst typically this is not noticeable, it is possible for ripples or air pockets to occur in this process. This does not constitute a fault with the product, and the product will return to normal after a period. Fixings. Screw and glue fixings are intentionally spaced out along edging to allow for the expansion and contraction expected of a plastic product. A slight colour differential is possible on grass from separate batches. Rhino Play cannot accept liability for minor colour variations, if additional grass is ordered on a different order. Our installation method states that we will install a sub-base of between 55mm and 70mm depending on the ground conditions. The excavation depth stated in the quote is excavation where necessary to put in our standard subbase of between 55mm- 70mm. This comprises of between 40mm and 50mm of type 1 aggregate and between 15mm and 20mm of grano dust. This will be installed either by excavating between 55mm and 70mm from the existing finish level of the lawn; or by building up the current level of lawn by this amount if stated in the quote as an alternative to excavation. If certain areas of the garden/play space exist naturally at a depth sufficient to install the sub-base or close to a depth sufficient to install the sub-base, less or no excavation may be required for this area compared to other areas of the garden/play space. This will have been taken into consideration when the surveyor calculated the quote. We will always keep the natural cambers of the lawn unless otherwise agreed between the Supplier and the Customer. It is not our intention to create a perfectly level lawn, except in circumstances that has been agreed and documented in our written Proposal. The Customer will accept that ground displacement of varying degrees is expected over time and that the stabilisation membrane and sub-base installed as listed in the method of works is intended to slow not prevent this process. Dips that occur in the lawn do not constitute a fault in the works provided. The products are manufactured using polyethylene and polypropylene and as such reflective, or magnifying surfaces, such as glass, clear plastic or reflective surfaces could cause scorching of the surface. It is the customer’s responsibility to prevent this and damage is not covered by the Guarantee. Repairs to scorched grass will be chargeable. The polyethylene and polypropylene temperature will increase under intense heat or sunlight. High traffic zones of an artificial lawn can flatten, pressure on the blades causes them to compress. This can give the grass a different appearance to the sections of lawn that are not compressed. Products proposed for usage by pets are a recommendation, and carry no guarantee specifically related to odour due to the varying
nature of sex, breed, diet and health of individual pets, the number of pets, or the size of the lawn in relation to the size of the pet. Customer Obligations The customer shall: Obtain all necessary permissions, licences and consents which may be required before the commencement of the services, the cost of which shall be the sole responsibility of the Customer. Provide the Supplier with any information reasonably required by the Supplier. It is the obligation of the Customer to inform the Supplier of any problematic issues with wildlife, such as moles in advance of the Supplier making a Proposal for works and thus completing an installation. If such information is provided additional preventative measures can be deployed and the installation method amended accordingly. Comply with such other requirements as may be set out in the Proposal or otherwise agreed between the parties. Electrical Cables. It is the obligation of the Customer to inform the Supplier of any electrical cables or pipe-work in the installation area that could be damaged by excavations or fixings. The Supplier will endeavour to identify such issues during a site survey, but cannot accept liability for subterranean damage caused to appliances and structures not previously notified. Building regulations state that cables must be armoured and buried 450mm below ground. We do not excavate to more than 80mm and as such Rhino Play will not be held responsible for any problems with cabled in the area to be grassed. The customer is obliged to notify the Supplier of any invasive plants such as Japanese knotweed, bamboo or tree roots that might spread beneath the installed lawn and cause material changes to the installation. The Supplier bears no liability for any damage caused in such a manner. Repairs to any damage caused to the installation by invasive plants will be chargeable and covered under a separate proposal. The Customer will ensure that someone is present at the start of the installation, to ensure mutual understanding of works to be undertaken, and at the end of the installation to agree satisfactory completion with the team leader. Failure to attend the completion of the installation and sign-off process will be taken as acceptance by the Customer of works conducted. In the absence of customer sign-off at completion of the installation, a £325 (ex VAT) call out will be levied for any subsequent revisit to correct issues not notified on completion.
* Rubber Grass Matting: Rubber grass matting shall be installed to follow the existing contours, gradients, and natural undulations of the ground surface. The matting is designed to conform to the underlying terrain and will not create a perfectly level or smooth finished surface. The Client acknowledges that any existing depressions, rises, unevenness, settlement, or irregularities in the ground may remain visible and/or perceptible following installation. Unless specifically included within the scope of works, no ground regrading, levelling, excavation, or remediation works are included. Surface Appearance; ripples, contours, and variations in the finished appearance of the rubber grass matting resulting from existing ground conditions shall not be considered defects in materials or workmanship. Drainage and Settlement; The Contractor shall not be liable for any future movement, settlement, subsidence, heave, erosion, or changes to the ground profile that may affect the appearance or performance of the installed matting after completion.
*Thermoplastic line markings have an expected lifespan of around 2 years. The lifespan for playground markings are subject to the condition of the existing surface, we will not be held accountable for any markings that do not live to their expected lifespan because of this. The guarantee does not apply if the product has been modified, repaired by anyone other than the manufacturer, accidental damage, abuse, neglect, chemical damage, weather extremes, subsidence, flood, vermin or criminal, war or terrorist damage or loss, lack of maintenance, discolouration and wear & tear. All colours are subject to ultra violet light degradation and ultra
violet light discolouration and as such total colour stability cannot be guaranteed.
*Maintenance Guarantee & Warranty; If our quotation is submitted to a required specification, we do not warrant or guarantee (either expressly or by implication) that such specification is suitable for the conditions to be met.
*NB – All guarantees will be null and void should a claim be made against them unless the WARRANTY REGISTRATION FORM is completed in its entirety and submitted to the warranty@rhinoplay.co.uk mail box within 28 days from date of invoice. Registering your warranty will also have the additional benefit of giving you entitlement to sign up for our yearly maintenance inspection programme at a discounted rate.
Licences, Permits Etc; our accounts shall be paid within 14 days of invoice, subject to account status and order value, advance payments may be required. Should, for any reason other than delay by Rhino Play (SW) Ltd, the confirmed delivery date of the goods be delayed, we reserve the right to invoice for goods and services undertaken to date, and payment will become due for the work(s) completed and invoiced. If not so paid then we reserve the right to charge interest thereon at the rate of 8% above the Bank of England minimum lending rate from the date on our invoice up until the actual date of the cleared funds in our account. When the work is carried out in stages then we reserve the right to submit our accounts for such portion or portions of work completed as aforesaid within 30 days of such account being posted by us, we reserve the right to suspend any further work without prejudice to any other remedy & / or right of action open to us. If a deposit is required this must reach us as clear funds 14 days before we are due to arrive on site to install the equipment, or provide the service, or services agreed in the quote. We understand that there are sometimes occasions & reasons why customers cannot or will not pay the 50% deposit. On such occasions both parties must agree an agreed payment term in writing before the contract commences.
Completion; We do not accept any liability for delays or the non-execution of the contract or agreed work either in whole or part that is due to causes beyond our control. The date that we may give for commencement of work is a ‘target date’ & as such we may require commencing work on, before or after that date. We may on occasions have to change the agreed date to a time agreeable to both parties without prejudice to the contract or quote agreed.
